Privacy Policy

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THIS SERVICE.

This privacy policy (“Privacy Policy”) describes the collection and use of data from users of the eoStar Application of eoStar and Associates (along with its affiliates, “eoStar,” “we” or “us” or “our”), and any other eoStar online service, Web site, or application that posts a link to this Privacy Policy, as well as any features, widgets, plug-ins, content, downloads or other services that are offered through the eoStar Application, or such other eoStar online service, Web site, or application (collectively, the “Services”). This Privacy Policy applies regardless of how you access or use the Services, whether it be via computer, tablet, mobile device, console, or otherwise.
The Services are owned and operated by eoStar. By accessing and using the Services you are indicating that you agree to and understand the collection and use of your information under this Privacy Policy and have read and understand the other terms and conditions of using the Services described in our Terms of Use. If you do not agree to this Privacy Policy or the Terms of Use, please exit now and do not use the Services.

INFORMATION WE COLLECT

When you interact with the Services, eoStar collects your information both actively and passively. eoStar may actively collect information when you provide such information through the Services, such as your full name, your e-mail address, your mailing address and your telephone number. You may also be given the opportunity to directly provide other personal information through the Services, as part of an order for products or services, inquiries or requests, or other situations in which you have chosen to provide information that identifies or is reasonably capable of being identified to you (“Personal Data”). eoStar also passively collects information from you when you interact with the Services that may or may not be Personal Data, such as details about your usage of the Services and your browser, operating system, and hardware, as well as your IP address or other unique device identifier and your physical location.

INFORMATION YOU MAY GIVE US DIRECTLY

We may request or otherwise give you the opportunity to share information with us directly in several ways during your interaction with the Services. For instance, you may share information with us during registration, completion of forms or emails, as part of an order for products or services, inquiries or requests or other situations in which you have chosen to provide Personal Data to eoStar.

AUTOMATED INFORMATION COLLECTION

At all times while you use or otherwise interact with the Services, information may be automatically collected from you. eoStar may collect this information using a variety of tracking technologies, such as cookies, web beacons, embedded scripts, browser fingerprinting, GPS, iBeacons, and ETags (or “entity tags”). A cookie (or “locally shared object”) is a data file placed on your device when you visit the Services that keeps a record of your use of the Services. This technology can make the Services more convenient for users in many ways, including by keeping users logged in across uses of the eoStar Application, Web site, or other application, and remembering user preferences across separate visits. Your device, browser, or other software may allow you to reject or remove cookies, but if you do so, some features of the Services may not work properly. If available, when you use the Services from a mobile or other device with location-tracking technology such as GPS, eoStar may collect information about your location and movement. This information can help facilitate certain user preferences and options. Information (including Personal Data) collected (either automatically or directly from you) may be stored on your device and on eoStar servers. With your consent, the Services may also access other device data or applications such as a camera or microphone. All information, including Personal Data, may be stored and used by eoStar in accordance with this Policy even if your account is deactivated, suspended or terminated or if you delete the eoStar Application from your device.

HOW WE USE COLLECTED INFORMATION

eoStar will not share any Personal Data collected through the Services without your consent, except as otherwise explicitly described in this Privacy Policy. eoStar may use the information collected from you, including Personal Data, for purposes of the realization of any agreement between you and eoStar, to fulfill a request from you for information or advice, to meet legal requirements, to provide the Services, to enable you to use certain features of the Services, to improve the Services, to develop marketing materials for the Services, to send you information about new products or services that suit your interest, to customize your use of the Services, to provide user support, or to enforce these Terms of Use. In addition, eoStar may use and share with third parties certain aggregated and/or de-identified data for a variety of purposes, including improving the Services. At no time will we sell your information, including Personal Data, to any third party without your express written consent. Further, your Personal Data will only be provided to (or used on behalf of) third parties for direct marketing purposes after you have been offered the opportunity to object thereto. Information collected by eoStar will be secured on eoStar servers using commercially reasonable measures.

WHEN WE MAY SHARE INFORMATION WITH THIRD PARTIES

eoStar may share Personal Data and/or other information about you with third parties where required by law, such as to satisfy any applicable law, regulation, subpoena, government request, or other legal process. eoStar may also share your Personal Data or other information with third parties, including law enforcement, to protect the Services and to enforce the Terms of Use. We also reserve the right to share your Personal Data or other information with our agents, subsidiaries and affiliates, and with any subsequent owner in the event of a merger, consolidation, sale of assets or other change in our corporate structure.

THIRD-PARTY SITES AND SERVICES

The Services may allow you to use your account from or otherwise link your eoStar account with other online services, including social media providers. If you use or connect to accounts from other services on the Services, those third parties may share personal or other information about you with eoStar, and we may share Personal Data or other information that we collect with them. Additionally, the Services may include links to third-party Web sites or other online services. eoStar is not responsible for these other sites and services, and they may collect and use Personal Data or other information about you. You should review the privacy policy of any Web site you visit carefully so that you understand how your information, personal or otherwise, is being collected and used.

ANALYTICS SERVICES

We may use third-party analytics services (such as Google Analytics) that track details about your online activities over time ‎and across different sites. These services help us to improve our Services. These services may also ‎allow us and others to provide you with targeted advertisements or other content that you may ‎be interested in based on your online activities. If you would like to ‎learn more about targeted ‎ads that may be based on your online activities, ‎and the choices that you ‎may exercise for certain ‎sites and advertisers, you may wish to visit the Network Advertising ‎Initiative or the Digital ‎Advertising Alliance. THIRD-PARTY TRACKING AND DO NOT TRACK

Third parties may use tracking technologies in connection with the Services, which may include the collection of information about your online activities over time and across different online platforms and devices. This Privacy Policy does not apply to these third-party tracking technologies because eoStar may not control them and is not responsible for them. Do Not Track is a technology that enables users to opt out of tracking by Web sites they do not visit directly. Currently, eoStar does not monitor or take any action with respect to Do Not Track technology.

UPDATING YOUR INFORMATION AND PREFERENCES

The Services may allow you to update certain Personal Data and preferences by logging into your account and visiting your user information page. You may also request that eoStar update or change your information by sending an email to support@eostar.comIf you receive direct marketing, e-mail newsletters, or other messages from us, and you would like to discontinue such receipt, you may use the “unsubscribe” features that are included in such messages, or contact eoStar at the e-mail address listed above.

INTERNATIONAL USERS

eoStar makes no claims that information on the Services are appropriate or may be downloaded outside of the United ‎States. Personal Data that is submitted to the Services will be collected, processed, stored, disclosed and ‎disposed of in accordance with applicable U.S. law and this Privacy Policy. If you are a non-U.S. user, you ‎acknowledge and agree that eoStar may collect and use your Personal Data and other information and store it on servers ‎and disclose it to other entities outside your resident jurisdiction. U.S. law may not provide the degree of protection ‎for Personal Data and other information that is available in other countries. By providing eoStar with your information, you ‎acknowledge that you consent to the transfer of such Personal Data and other information outside your resident ‎jurisdiction as detailed in this Privacy Policy. If you do not consent to such transfer, you may not use the Services.‎

CHILDREN’S PRIVACY

Our Services are intended for general audiences, and eoStar does not knowingly seek or collect personal information from children under the age of 18. In accordance with the Child Online Privacy Protection Act, in the event that eoStar learns that the Services have collected Personal Data from a child under age 13 without verification of parental consent, eoStar will delete that information as quickly as possible. If you believe that we may have any Personal Data from or about a child, please contact us at support@eostar.com.

CHANGES TO THIS PRIVACY POLICY

eoStar may revise this Privacy Policy at any time without prior notice by updating this page, and such revisions will be effective upon posting to this page. Please check this Privacy Policy periodically for any changes. Your continued use of the Services following the posting of any revisions to this Privacy Policy will mean you accept those changes. eoStar reserves the right to alter, suspend or discontinue any aspect of this Services, including your access to them. Unless explicitly stated, any new features will be subject to this Privacy Policy. eoStar may assign, novate or subcontract any or all of its rights and obligations under this Privacy Policy at any time.

SECURITY

eoStar will take reasonable steps to secure your information and Personal Data. Unfortunately, however, no security system can be guaranteed to be entirely secure, and we do not control the data security practices of any third-parties. In the event of a data breach with respect to your Personal Data, we will notify you in accordance with our legal obligations.
